Terms of Use
These terms govern your use of the Focus Clock mobile application ("Focus Clock", "the app"), published by Kosmia Labs. By downloading or using the app you agree to them.
01 — Acceptance
By installing or using Focus Clock you accept these terms and our Privacy Policy. If you do not agree, do not install or use the app. If you use the app on behalf of someone else (for example, a child in your care), you accept these terms on their behalf.
02 — License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Focus Clock on devices that you own or control, for your personal, non-commercial use, in accordance with these terms and with the usage rules of the app store you obtained it from.
03 — Restrictions
You may not: copy, distribute, sell, rent, lease or sublicense the app; modify, decompile, disassemble or reverse-engineer it except to the extent applicable law expressly permits despite this restriction; remove or alter any proprietary notices; or use the app in any unlawful way or in violation of the app store's terms.
04 — Intellectual property
The app, including its design, clock faces, themes, code, graphics and branding, is owned by Kosmia Labs and protected by copyright and other intellectual-property laws. These terms grant you a right to use the app; they do not transfer any ownership to you.
05 — Your data
Focus Clock stores your settings, timers and session history locally on your device only, as described in the Privacy Policy. The app does not include a backup or sync feature in version 1.0: uninstalling the app or clearing its data permanently deletes this information, and we have no way to restore it. You are responsible for anything you rely on the data for.
06 — Updates & availability
We may release updates that add, change or remove features, and we may discontinue the app or any feature at any time. Updates are delivered through the app store and may be required for continued use. We are not obliged to provide any particular update or to maintain any feature.
07 — Disclaimer of warranties
Focus Clock is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. In particular, while the app's timers and clocks are engineered to be accurate, we do not warrant that they are error-free, and the app must not be relied upon where a timing failure could cause harm — including medical, safety-critical, industrial or aviation contexts. The app is not an alarm-clock replacement for critical wake-ups in version 1.0.
08 — Limitation of liability
To the maximum extent permitted by law, Kosmia Labs shall not be liable for any indirect, incidental, special, consequential or exemplary damages — including missed events, lost productivity, lost data or lost profits — arising from your use of, or inability to use, the app. Where liability cannot be excluded, our total aggregate liability is limited to the amount you paid for the app in the twelve months before the claim arose, or ten euros, whichever is greater. Nothing in these terms excludes liability that cannot be excluded under applicable law, including for intent, gross negligence, or injury to life, body or health.
09 — App store terms
The app is distributed through the Apple App Store and Google Play, and their terms also apply to your download. Apple and Google are not parties to these terms, are not responsible for the app or its support, and have no warranty or maintenance obligations for it. For the app obtained via the Apple App Store: Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you; Apple's responsibility in the event the app fails to conform to any applicable warranty is limited to refunding the purchase price, if any.
10 — Termination
These terms apply until terminated. They terminate automatically if you breach them; you may terminate them at any time by uninstalling the app. On termination, the license in section 02 ends and you must stop using the app. Sections 04, 07, 08 and 11 survive termination.
11 — Governing law
These terms are to be interpreted under generally applicable principles of contract law. Mandatory consumer-protection law of the country in which you reside remains unaffected, and nothing in this section deprives you of protections or forums granted to you by that law.
12 — Changes to these terms
We may update these terms when the app or the legal requirements change. The updated version will be published at this address with a new effective date, and material changes will be noted in the app's release notes. Continued use of the app after a change takes effect constitutes acceptance of the updated terms.
